1. Definitions
The "Hirer" means StayMobile. The "Customer" means the person, company or other body taking the Equipment on hire. The "Equipment" means the wheelchair, walker or other item, and any accessories, supplied by StayMobile. The "Rental Period" means the period from the time the Customer takes possession of the Equipment until it is returned to StayMobile.
2. Ownership of equipment
The Equipment remains the property of StayMobile. The Customer only receives the right to use the Equipment for the agreed Rental Period and does not acquire ownership of it.
3. Payment
The full rental amount, including any agreed delivery and collection fees, is payable before the Rental Period begins unless otherwise agreed in writing by StayMobile. Payment may be made by the payment methods communicated by StayMobile.
4. Security deposit
A refundable security deposit of R500 is payable together with the rental fee, before the Rental Period begins. It is held against loss of or damage to the Equipment. The deposit is refunded in full once the Equipment has been returned and inspected, less any reasonable costs for damage, loss, missing accessories or excessive cleaning.
5. Advance booking
A booking is secured only once the required rental payment has been received. Once booked, StayMobile will reserve the Equipment for the agreed Rental Period, subject to availability.
6. Cancellations
Cancellation terms will be confirmed at the time of booking. Any cancellation fee or refund applicable to the booking will be recorded on the booking confirmation or invoice.
7. Condition, damage or loss
The Equipment will be supplied clean, sanitised and in working order, subject to normal wear and tear. The Customer agrees to take reasonable care of the Equipment and to notify StayMobile as soon as possible if it is damaged, lost, stolen or becomes unsafe to use. The Customer may be responsible for reasonable repair, replacement, cleaning or missing-accessory costs resulting from damage or loss during the Rental Period, to the extent permitted by applicable law.
8. Safe use & customer responsibility
The Customer is responsible for using the Equipment appropriately and for following any safety or operating instructions supplied by StayMobile or the Equipment manufacturer. The Customer must ensure that the Equipment is suitable for the intended user, including weight capacity, physical needs and the environment in which it will be used. StayMobile should be informed of any relevant requirements before the rental begins.
9. Late return
The Equipment must be returned at the agreed time and date. A late-return fee may apply for equipment kept beyond the agreed Rental Period. If the Equipment is not returned and StayMobile is unable to contact the Customer, the Equipment may be treated as lost and the applicable replacement cost may become payable, subject to applicable law and the agreed booking terms.
10. Alterations & repairs
The Customer may not modify, dismantle, repair or alter the Equipment without StayMobile's written permission. Any issue with the Equipment should be reported to StayMobile so that appropriate instructions can be provided.
11. Re-hiring / loaning
The Equipment may not be re-hired, sub-let or loaned to another person without the prior knowledge and consent of StayMobile.
12. Risks & limitation of liability
The Customer acknowledges that the Equipment is mobility equipment and that use involves inherent risks, including falls, tipping, collisions and injury if used incorrectly or in an unsuitable environment. The Customer is responsible for safe use and supervision where appropriate. StayMobile will not be responsible for loss, damage, injury or death to the extent caused by the Customer's misuse, negligence, failure to follow instructions, or use of the Equipment outside its intended purpose. Nothing in this agreement excludes or limits any liability that cannot lawfully be excluded or limited.
13. Non-variation
The rental agreement is subject to these conditions and the booking details confirmed with the Customer in writing. Any variation should be agreed in writing by StayMobile and the Customer.
14. Waivers
Any waiver or variation of these conditions must be confirmed in writing by StayMobile to be effective.
15. Customer confirmation
By ticking the box when sending a booking request, and by signing at handover, the Customer confirms that the information supplied is accurate, that they have read and understood the rental conditions, and that they agree to return the Equipment in the condition in which it was supplied, allowing for normal wear and tear.
